Valid Grounds for Divorce in Texas State
According to CDC statistics, Texas has a fairly low divorce rate, just 2.1 per 1,000 people.
Texas allows arranging both "fault" and "no-fault" divorces. Before the spouses submit documents to the court, they should resolve their controversial issues. Thus, they will be able to proceed with an uncontested divorce and get the final decree faster and cheaper. No-fault grounds perfectly suit amicable dissolution. They include:
- Insupportability (marriage is too unbearable due to conflicts between spouses)
- Living apart (spouses should live separately and without cohabitation for at least three years)
- Confinement to a mental hospital (one of the spouses is placed in a psychiatric hospital with no chance of recovery)
Texas also allows filing for divorce based on fault grounds. It means that one of the spouses is guilty of the marriage collapse. Acceptable fault grounds for divorce in Texas are:
- Cruelty (the cruelty of one of the spouses makes a living together impossible)
- Adultery (one of the spouses has cheated)
- Conviction of a felony (one of the spouses has been in prison for more than one year for a crime and has not been pardoned)
- Abandonment (one of the spouses deliberately left the partner and has been living separately for at least one year)
